1. Who these terms are with
These Campaign Terms & Conditions (“Terms”) are between you and From The Land LLC (“From The Land,” “we,” “us,” or “our”) and apply to gifts, campaign rewards, workshops, services, and other purchases made through the From The Land crowdfunding campaign at fromtheland.us/crowdfunding.
By completing checkout, you agree to these Terms, the description of the reward or service you selected, and any additional written scope or agreement that applies to that item. If a separately signed written agreement conflicts with these Terms, the separately signed agreement controls for that transaction.
2. This is flexible funding, not an all-or-nothing campaign
The public $150,000 goal is a campaign milestone, not a condition of payment. Square charges your payment when you complete checkout. From The Land may use campaign proceeds as they are received for the priorities described on the campaign page, including the Cherry Valley property, Littlest Big Farm development and production, tools, materials, fabrication capacity, and related business needs. Those priorities are not fixed dollar allocations.
Support of From The Land LLC is support of a for-profit business. Gifts and reward payments to From The Land are not charitable donations and are not represented as tax-deductible.
3. Gifts with no reward
If you choose a gift with no reward, you are voluntarily supporting From The Land and are not purchasing equity, debt, profit sharing, or any other investment interest. Gifts are generally final once processed, except for duplicate charges, unauthorized transactions, processing errors, or refunds required by law.
4. Rewards and experiences
A reward payment entitles you to the specific reward, quantity, or experience shown in your cart and Square order, subject to these Terms. Reward availability may be limited. We will not substitute a materially different reward without your agreement.
Reward photos, prototypes, and examples are illustrative unless the reward description says otherwise. Handmade, grown, live, custom, and small-batch items can have reasonable natural or production variations.
5. Fulfillment queues, batches, timing, and delays
Physical rewards are placed in a fulfillment queue in the order paid. Some rewards are released in capacity-based batches. A Batch 1 limit is the amount we are committing to in that release, not necessarily a lifetime limit; if demand and production capacity allow, we may open later batches with later fulfillment windows.
The reward page shows our current estimated fulfillment or scheduling window for each reward. We make those estimates based on the capacity, materials, inventory, staffing, biological production, and scheduling information reasonably available to us when the order is accepted. For physical merchandise ordered online, if we cannot ship within the timeframe stated when you ordered, we will communicate the delay and provide the delay-consent, cancellation, or refund option required by applicable law.
If we determine that we cannot provide a paid reward, we will refund the unfulfilled portion rather than substitute store credit. For a multi-delivery reward, such as the 24-delivery mealworm subscription, a refund for nonfulfillment may be prorated to the undelivered portion.
6. Shipping, pickup, and delivery
For standard shippable campaign rewards within the United States, the cart applies one flat campaign shipping fee using the highest applicable shipping class in the cart. The current classes are $1 for the handwritten thank-you card, $5 for small mailed items such as tea or a small supporter gift, $10 for items such as mealworms, mushroom kits, and mystery boxes, and $15 for larger custom or 3D-printed rewards. When a flat campaign shipping fee is charged at checkout, that is the full campaign shipping charge for the standard shipment; we do not later increase that flat fee because our actual postage was higher.
Some rewards are not suited to a single flat shipping charge. Hydroponic tower delivery/freight and pickup or shipping arrangements for the 24-delivery mealworm subscription are identified before checkout as being coordinated separately. No delivery charge for those separately coordinated arrangements is collected at campaign checkout, and we will agree on any later delivery or shipping charge with you before it is incurred. Littlest Big Farm delivery is governed by the separate reservation and later Final Purchase Agreement.
Square collects a US shipping address when a standard shippable reward is in the cart. Contact us before ordering if delivery is outside the United States so we can confirm availability and shipping arrangements.
7. Live and perishable rewards
Live mealworms and other living or perishable items are affected by weather, carrier handling, and biological variation. If a live-item shipment arrives materially damaged or nonviable, contact us promptly, preferably within 24 hours of delivery, with enough information for us to evaluate the problem. We will provide an appropriate replacement, refund, or other remedy when warranted and as required by law.
8. Workshops, tours, and services
Workshop vouchers offered by this campaign are intended to be used within 12 months of purchase unless the reward description says otherwise. Seats are released in capacity-based batches, and available dates are offered in payment order and scheduled by mutual availability. In-person workshops may require agreement on location, travel, or other logistics. A sponsored tour depends on scheduling and participation by the applicable school, homestead, or group.
If we cannot offer a purchased workshop, tour, or service within the stated eligibility period after reasonable scheduling efforts, you may choose an available comparable option or a refund of the unfulfilled amount.
On-site farm visits, animal experiences, founder-for-a-day rewards, build days, and similar hands-on experiences are scheduled by mutual availability and may require reasonable safety rules, age restrictions, closed-toe footwear or other protective equipment, guardian consent for minors, and a participation or liability waiver when appropriate. We may modify or decline an activity that cannot be provided safely or lawfully; if we cannot provide the purchased experience at all, we will offer an available comparable option or refund the unfulfilled amount.
9. Custom printing, CAD, and prototype work
Custom work is capacity-limited and queued in the order paid. The campaign page states the included scope for the small and deluxe CAD tiers. Custom work requires a written agreement on scope, deliverables, materials, schedule, and any special costs before substantive work begins. If we cannot agree on a workable scope, we will refund the applicable reward payment rather than begin the project.
For custom CAD rewards, ownership and showcase rights are as described in the selected reward and any later written scope. Prototype-development support is not purchased through ordinary reward checkout unless we have first agreed on scope and, when appropriate, signed an NDA. We do not promise that prototype support will result in a finished commercial product, patentability, regulatory approval, or market success.
10. Cancellations, returns, and refunds
You may request cancellation of a standard reward before it has shipped, been scheduled, or entered custom production. We will honor cancellation requests when required by law and otherwise when reasonably practical. Once a custom item has entered production, a service has been substantially performed, or a live/perishable item has shipped, change-of-mind refunds may not be available.
If an item arrives defective, materially damaged, or materially different from what was promised, contact us promptly so we can provide an appropriate repair, replacement, refund, or other legally required remedy.
Nothing in these Terms limits refund, cancellation, warranty, or consumer rights that cannot legally be waived.
11. Littlest Big Farm Priority Reservations
A Littlest Big Farm Priority Reservation is governed by the separate Littlest Big Farm Reservation Terms. The $6,000 reservation secures approximate production priority; it is not the purchase of a farm, does not fix final specifications or price, and does not authorize delivery, construction, installation, electrical work, or solar work. The reservation remains fully refundable until a later Final Purchase Agreement is signed.
For transparency, the campaign may include completed Littlest Big Farm Priority Reservation payments in a total campaign backing figure. Reservation payments are identified separately from gifts and reward purchases because they remain refundable until the applicable Final Purchase Agreement is signed.
Any delivery/placement, site work, turnkey installation, solar + battery system, or custom configuration selected as an interest during reservation checkout is non-binding and carries no additional charge at the reservation stage. Those items are evaluated, priced, and contracted separately as applicable. Where contractor or electrical licensing is required, the responsible work will be contracted and performed by an appropriately licensed party.
12. Taxes and payment processing
Square processes campaign checkout and may add or collect applicable taxes based on the transaction. Your Square receipt is your payment record. We do not receive or store your full payment-card number through the campaign website.
13. Public recognition
You can choose to be recognized publicly or remain anonymous on the campaign page. If you choose public recognition, we will display only the public name you provide for that purpose. We may remove a public name that is deceptive, unlawful, abusive, or inappropriate for the site.
14. Esperanza, loans, and investments are separate
Donations to Esperanza’s Sanctuary are made through Esperanza’s separate Zeffy donation page and are governed by that organization’s terms and tax treatment. Business loans and SAFE investments are arranged directly with From The Land under separate written agreements; they are not purchased through this reward checkout.
15. No guarantee of project, agricultural, or financial outcomes
We will make the specific good-faith efforts and provide the specific deliverables described in the campaign and your order. However, agriculture, product development, construction, prototyping, and business expansion involve uncertainty. We do not guarantee crop yields, savings, profitability, investment returns, permit approval, site suitability, or a particular business outcome unless a later written agreement expressly provides a specific guarantee.
16. Changes and communication
We may update these Terms for future transactions as the campaign develops. The version presented and accepted at the time you check out governs that checkout, unless a later change is required by law or you separately agree to it. We will use campaign updates and direct contact information available from your order when we need to communicate material fulfillment changes.
17. Governing law
These Terms are governed by the laws of the State of California, without limiting any non-waivable consumer protection that applies to you where you live. Before filing a dispute, we ask that you contact us and give us a reasonable opportunity to resolve the issue informally. Nothing here prevents either party from using a court or agency process that applicable law makes available.
